The Fair Labor Standards Act (FLSA) is a very important federal law that protects the basic rights and standards governing employment - particularly in regards to pay and overtime work - in the United States. The law was originally written in 1932 and was passed with modifications in 1938. Over the years, this landmark piece of legislation has received a number of important amendments.

Among other things, the FLSA requires that every covered employee receive:

  • Minimum wage or more
  • Overtime pay of 1.5 times the regular pay for hours worked in excess of 40 hours over the course of a work week
  • Records of hours and pay kept by his or her employer
  • Be properly classified as non-exempt or exempt

In this so-called “gig economy,” many employers wrongly believe that they can make any employee an independent contractor. The employer is trying to save on payroll taxes, overtime, and/or employee benefits. And it is the employee and his or her family who suffer.
